1. Agreement to Terms
These Terms of Service (“Terms”) form a binding agreement between you and Hilaron, Inc. (“Hilaron,” “we,” “us,” or “our”) governing your access to and use of the Hilaron mobile applications, websites, dashboards, and related services (collectively, the “Service”).
By creating an account, browsing campaigns, making a donation, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Definitions
- Donor — an individual using Hilaron to discover causes, give to campaigns, or join social giving groups.
- Organization — a nonprofit, charity, ministry, or other mission- driven entity that uses Hilaron to publish campaigns, accept donations, and engage supporters.
- Campaign — a fundraising appeal published by an Organization on the Service.
- Contribution — any donation, recurring gift, tip, or other payment processed through the Service.
- Content — text, images, video, logos, campaign descriptions, comments, and any other material submitted to or displayed on the Service.
3. Eligibility & Accounts
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You must be at least 18 years old to make a Contribution or to register an Organization account.
When you create an account you agree to provide accurate information, keep your credentials confidential, and notify us promptly at [email protected] of any unauthorized use. You are responsible for all activity that occurs under your account.
Authentication and account data are managed through Google Firebase Authentication. By signing in with a third-party identity provider (such as Apple, Google, or email), you authorize us to receive the information necessary to create and maintain your account.
4. Donor Terms
As a Donor, you acknowledge that:
- Contributions are voluntary and, except where required by law, generally non-refundable.
- Hilaron is a technology platform — we do not solicit donations on behalf of any particular Organization, and we make no guarantee that an Organization will use funds in any specific manner.
- Tax deductibility depends on the Organization’s status in your jurisdiction. Receipts generated through the Service are provided for your records; you are responsible for confirming deductibility with a qualified tax advisor.
- Recurring Contributions will continue at the cadence you select (monthly, quarterly, or annually) until you cancel them through your dashboard or by contacting us.
- You may choose to give anonymously on a per-Contribution basis. Even when an Organization does not see your identity, Hilaron retains records as required for payment, fraud prevention, and tax purposes.
5. Organization Terms
If you register or operate an Organization account, you represent and warrant that:
- You are authorized to act on behalf of the Organization and to accept these Terms on its behalf.
- The Organization is in good standing under the laws of its formation jurisdiction and, where claimed, holds valid tax-exempt or charitable status.
- All campaign descriptions, financial goals, beneficiary information, photographs, and impact claims are accurate, lawful, and not misleading.
- Funds received through the Service will be used solely for the charitable purposes stated in the relevant Campaign.
- You will comply with all applicable fundraising, solicitation, charitable registration, sanctions, anti-money-laundering, and tax laws — including providing donor receipts that meet jurisdictional requirements.
We may require verification documentation (including beneficial ownership, EIN or equivalent, or charity registration) before activating payouts. We may suspend or terminate Organization accounts that fail verification or that we reasonably believe to be engaged in fraud, misrepresentation, or unlawful activity.
6. Donations, Fees & Payouts
All Contributions are processed by Stripe, Inc. and are subject to Stripe’s Connected Account Agreement and applicable terms. Hilaron does not store full payment card details.
Each Contribution is subject to (i) standard payment processing fees charged by Stripe (currently 2.9% + $0.30 per successful card transaction, with rates for other payment methods as published by Stripe) and (ii) a Hilaron platform fee determined by the Organization’s subscription tier:
- Free tier: 5% platform fee
- Essential tier: 3% platform fee
- Premium tier: 2% platform fee
Donors may, at checkout, optionally elect to cover platform and processing fees so that 100% of the intended gift reaches the Organization.
Payouts to Organizations are issued by Stripe on Stripe’s standard schedule (typically 2–7 business days after settlement). Premium plan Organizations may be eligible for expedited payouts. Payout availability, holds, and reserves are governed by Stripe and may be adjusted in response to risk signals or chargebacks.
Disputed transactions, chargebacks, refunds, and reversals will be debited from the Organization’s connected balance. Organizations are responsible for any negative balance and for resolving disputes with their donors.
7. Subscription Plans
Organizations may subscribe to paid Hilaron plans (Essential or Premium) on a monthly or annual basis. Subscription fees are billed in advance, are non-refundable except where required by law, and renew automatically until canceled.
You may cancel a paid subscription at any time from your dashboard or by contacting [email protected]. Cancellation takes effect at the end of the current billing period; downgrade to the Free tier preserves donor data but reverts feature access and platform fee rates accordingly.
We may change subscription pricing or feature inclusions with at least 30 days’ notice prior to your next renewal. Continued use after the change constitutes acceptance of the revised pricing.
8. Refunds
Because Contributions are typically transferred to Organizations shortly after they are made, donations are generally non-refundable. We may, in our sole discretion, issue a refund of the donation principal in cases of (a) duplicate or accidental Contributions, (b) confirmed fraudulent use of a donor’s payment instrument, or (c) where an Organization is removed from the Service for material misconduct prior to payout.
Where a refund is issued, payment processing fees may be non-recoverable from Stripe and may be retained or deducted accordingly.
Refund requests should be sent to [email protected] within 60 days of the original Contribution.
9. Acceptable Use
You agree not to use the Service to:
- Solicit funds for any purpose that is unlawful, fraudulent, deceptive, hateful, harassing, or that promotes violence or discrimination.
- Misrepresent your identity, your affiliation with any organization, or the use of funds.
- Launder money, finance terrorism, evade sanctions, or violate any anti-money-laundering or know-your-customer requirements.
- Upload Content that infringes intellectual property, privacy, publicity, or other rights of any person.
- Interfere with or disrupt the Service, attempt to gain unauthorized access, probe for vulnerabilities, or scrape data outside of officially documented APIs.
- Use the Service to send spam, unsolicited communications, or to harvest information about other users.

We reserve the right to remove Content, suspend accounts, withhold payouts, or terminate access where we reasonably believe a violation has occurred.
10. User Content & License
You retain ownership of Content you submit to the Service. By submitting Content, you grant Hilaron a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute that Content solely as necessary to operate, promote, and improve the Service.
Organizations grant donors a limited license to share Campaign Content for the purpose of personal advocacy and amplification. You represent that you have all rights and permissions necessary to grant these licenses.
11. Hilaron Intellectual Property
The Service, including its software, design, branding (the Hilaron name, logo, and wordmark), and underlying technology, is owned by Hilaron and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
No rights are granted by implication or estoppel. You may not reverse engineer, copy, or create derivative works of the Service except as expressly permitted.
12. Third-Party Services
The Service relies on third-party providers, including Stripe (payments), Google Firebase (authentication, database, storage, hosting, and cloud functions), and the Apple App Store and Google Play (mobile distribution). Your use of these services is also governed by the third party’s terms, and Hilaron is not responsible for the acts, omissions, or service availability of any third party.
Mobile applications obtained through Apple or Google are additionally subject to those stores’ end-user license agreements.
13. Privacy & Data Protection
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. We employ industry-standard safeguards including AES-256 encryption in transit and at rest, and we contractually require sub-processors such as Stripe (PCI DSS Level 1) and Firebase to maintain appropriate security controls.
We comply with applicable data-protection regimes including the GDPR and CCPA. Donors and Organizations may exercise data access, correction, portability, and deletion rights through the in-app settings or by emailing [email protected].
14. Suspension & Termination
You may close your account at any time. We may suspend or terminate your access — and withhold related payouts — if you breach these Terms, if required by law or a payment provider, or if continued provision of the Service to you creates undue risk to other users.
Upon termination, the licenses you grant to Hilaron in your Content remain in force to the extent necessary to honor in-progress Contributions, fulfill legal record-keeping obligations, and operate the Service for other users.
15. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Hilaron disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of Content, and uninterrupted or error-free operation.
Hilaron does not endorse any Organization and makes no representation regarding the legitimacy, tax status, or use of funds by any Organization. Donors are encouraged to conduct their own due diligence before contributing.
16. Limitation of Liability
To the fullest extent permitted by law, Hilaron, its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses arising out of or related to the Service.
Hilaron’s total aggregate liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount of platform fees paid to Hilaron by you in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
17. Indemnification
You agree to defend, indemnify, and hold harmless Hilaron and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (i) your use of the Service, (ii) your Content, (iii) your violation of these Terms or applicable law, or (iv) your violation of any third-party right.
18. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, United States, and the parties consent to personal jurisdiction in those courts.
Where permitted by law, the parties waive any right to a trial by jury and to participate in any class or representative action arising out of these Terms.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app notice) before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
